Your order for purchase constitutes your "offer," which shall be subject to the terms and conditions listed below. Deevaz.in reserves the right to accept or reject your offer. Deevaz.in shall have the royalty-free, worldwide, perpetual, irrevocable, and transferable right to use, copy, distribute, display, publish, perform, sell, lease, transmit, adapt, create derivative works from such Submissions by any means and in any form, and to translate, modify, reverse-engineer, disassemble, or recompile such Submissions. All Submissions shall automatically become the sole and exclusive property of Deevaz.in and shall not be returned to you.

3. RISK OF LOSS & OTHER TERMS OF SALE

The risk of loss and title for items purchased by you pass to you upon Deevaz.in's delivery of the items to the carrier, in accordance with Deevaz.in's standard terms of sale.

4. TERMINATION AND EFFECT OF TERMINATION

In addition to any other legal or equitable remedies, Deevaz.in may, without prior notice to you, immediately terminate this Agreement or revoke any or all of your rights granted under this Agreement. Upon termination of this Agreement, you must immediately cease all access to and use of the Site. Deevaz.in shall, in addition to any other legal or equitable remedies, immediately revoke all password(s) and account identification issued to you and deny your access to and use of the Site, either in whole or in part. Any termination of this Agreement shall not affect the respective rights and obligations (including, without limitation, payment obligations) of the parties that arose prior to the termination date.

5. INTERNATIONAL ACCESS

This Site may be accessed from countries other than India. This Site may contain references to products that are not available outside of India. Such references do not imply that these products will be made available outside of India. If you access and use this Site from outside India, you are responsible for complying with your local laws and regulations.

7. TYPOGRAPHICAL ERRORS

In the event that a product is listed at an incorrect price or with incorrect information due to a typographical error or error in pricing or product information received from our suppliers, Deevaz.in reserves the right to refuse or cancel any orders placed for products listed at the incorrect price. Deevaz.in also reserves the right to refuse or cancel such orders regardless of whether the order has been confirmed and your credit card charged. If you have already been charged for a purchase and your order is canceled, Deevaz.in will immediately issue a credit to your account for the amount of the charge.

10. REMEDIES

You agree that Deevaz.in's remedy at law for any actual or threatened breach of this Agreement would be inadequate and that Deevaz.in shall be entitled to specific performance or injunctive relief, or both, in addition to any damages that Deevaz.in may be legally entitled to recover, along with reasonable expenses for any form of dispute resolution, including but not limited to attorneys' fees. No right or remedy of Deevaz.in shall be exclusive of any other, whether at law or in equity, including but not limited to damages, injunctive relief, attorneys' fees, and expenses. No instance of waiver by Deevaz.in of its rights or remedies under these terms and conditions shall imply any obligation to grant any similar, future, or other waiver.

11. ENTIRE AGREEMENT

If any part of this Agreement is determined to be invalid or unenforceable under applicable law, including but not limited to the warranty disclaimers and liability limitations set forth above, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely reflects the intent of the original provision, and the remainder of the Agreement shall continue in full effect. 14. DISPUTES AND JURISDICTION

In the event of any breach of terms or violation of this Agreement, you agree to notify Deevaz.in in writing about the possible breach and provide at least 90 days for Deevaz.in to investigate and rectify such breach or violation. In the unlikely event that Deevaz.in fails to do so, you agree to serve a legal notice to Deevaz.in clearly outlining the breach, with supporting evidence, and give Deevaz.in an additional 90 days to respond and rectify the breach (if applicable and within Deevaz.in's control). This notice should be sent via email to: support@deevaz.in.

If a settlement is not reached, you may initiate legal action or file a complaint against Deevaz.in before the appropriate Court of Law or authorities such as the Consumer Court. This Agreement shall be governed by and construed in accordance with the applicable laws and the Constitution of the Republic of India, and it is subject to the exclusive jurisdiction of the Honorable Courts of Tamil Nadu.

15. INDEMNITY

You agree to defend, indemnify, and hold harmless Deevaz.in, its employees, directors, officers, agents, representatives, business partners, service providers, and their respective successors and assigns, from and against any and all claims, liabilities, damages, losses, costs, and expenses, including attorney's fees, arising from or relating to your actions or inactions. This includes, but is not limited to, claims based on breach of any warranties, representations, or undertakings, non-fulfillment of obligations under this User Agreement, or violation of applicable laws or regulations, including Intellectual Property Rights, payment of statutory dues and taxes, claims of libel or defamation, violation of privacy or publicity rights, loss of service to other users, and infringement of intellectual property or other rights. This indemnification obligation shall survive the expiration or termination of this User Agreement.

16. PRICING INFORMATION

While Deevaz.in strives to provide accurate product and pricing information, typographical or pricing errors may occur. Deevaz.in cannot confirm the price of a product until after you have placed your order. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product details, Deevaz.in reserves the right, at its sole discretion, to refuse or cancel any orders placed for that product, unless the product has already been dispatched. If an item is mispriced, Deevaz.in may, at its discretion, either contact you for further instructions or cancel your order and notify you of such cancellation. Unless the product you ordered has been dispatched, your offer will not be considered accepted, and Deevaz.in reserves the right to modify the price of the product and contact you for further instructions via the email address you provided during registration or to cancel the order and notify you of the cancellation.

If Deevaz.in accepts your order, the corresponding payment will be debited from your account, and you will be notified via email that the payment has been processed. Payment may be processed prior to the dispatch of the product you ordered. If Deevaz.in needs to cancel your order after processing the payment, the amount will be reversed to your account.

CANCELLATION BY DEEVAZ

Please note that certain orders may be subject to cancellation. Deevaz.in reserves the right, at its sole discretion, to refuse or cancel any order for any reason. Situations that may result in the cancellation of your order include, but are not limited to, limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or issues identified by our credit and fraud prevention department. We may also require additional verification or information before accepting an order.

If your order is cancelled after your credit card has been charged, the amount will be reversed to your account. We will contact you if all or any portion of your order is cancelled, or if additional information is required to complete your order.

CANCELLATION BY CUSTOMER

If we receive a cancellation request and the order has not been shipped, we will cancel the order and refund the entire amount to your wallet. Orders that have already been shipped cannot be cancelled. In such cases, please refer to our return policy for further assistance.

By placing an order, the customer agrees not to dispute Deevaz.in's decision regarding cancellations and accepts the final decision made by Deevaz.in.
